1. Who you are contracting with

Primagen Research is a sole proprietorship based in British Columbia, Canada. In these Terms, "we," "us," and "Primagen Research" refer to that business and its owner. You can reach us at primagenpeps@gmail.com.

2. Acceptance

By accessing this site, confirming your age, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the site.

3. Research use only

All products sold on this site are supplied strictly for in-vitro laboratory research and development purposes. They are not drugs, foods, cosmetics, medical devices, or dietary supplements. They are not approved by Health Canada or the U.S. Food and Drug Administration.

Our products are not for human or veterinary consumption, ingestion, injection, application, or administration of any kind. No statement on this site should be read as a claim that any product diagnoses, treats, cures, prevents, or mitigates any condition, or is safe or effective for use in humans or animals.

4. Eligibility

To purchase, you represent and warrant that you:

• are at least 21 years of age;
• are a qualified researcher, or are acquiring products on behalf of a research institution or laboratory;
• possess the training and facilities to handle research materials safely and lawfully;
• will not resell, redistribute, or supply the products for human or animal use; and
• will comply with all applicable laws in your jurisdiction.

We may refuse, cancel, or limit any order at our discretion, including where we believe these representations are untrue.

5. Your responsibility for lawful use

You are solely responsible for determining whether your purchase, possession, and use of any product is lawful where you are located, and for using it safely. Once a product leaves our possession, you assume full responsibility for its handling, storage, use, and disposal.

6. Accounts

You are responsible for the accuracy of your account details and for keeping your password confidential. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorised use.

7. Pricing and payment

All prices are in Canadian dollars (CAD) and may change without notice. We accept cryptocurrency and Interac e-Transfer. Orders are not processed until payment is confirmed. Cryptocurrency payments are irreversible once confirmed on the blockchain. You are responsible for any network or transaction fees charged by your wallet or payment provider.

We make reasonable efforts to describe products and prices accurately, but errors can occur. If a product is listed at an incorrect price or with an incorrect description, we may cancel the order and refund any amount paid.

8. All sales are final

Because our products are temperature-sensitive research materials whose storage conditions cannot be verified once they leave our custody, all sales are final. We do not accept returns or exchanges, and we do not issue refunds for change of mind, ordering the wrong item, or a product no longer being needed.

This does not apply where an order is not delivered at all, arrives damaged, or is materially different from what you ordered. In those cases, contact us at primagenpeps@gmail.com within 7 days of delivery (or expected delivery) and we will work with you to resolve it. Nothing in these Terms removes rights you have under applicable consumer protection law that cannot be waived by agreement.

United States orders are an exception. If you order from the U.S. you are the importer of record, and shipments detained, seized, refused, returned, or destroyed by a customs or regulatory authority are at your risk and are not refunded or replaced. You are responsible for confirming that importing and possessing these products is lawful where you live. See our Shipping Policy for the full terms.

9. Shipping

See our Shipping Policy for dispatch times, costs, and delivery details. Title and risk of loss pass to you on delivery to the carrier, subject to Section 8.

10. Points program

Points are earned on paid orders at the rate shown on the site and may be redeemed for discounts as described. Points have no cash value, are not property, are not transferable, and cannot be sold or exchanged. We may change or discontinue the points program, or adjust point balances to correct errors or address abuse, at any time.

11. Prohibited conduct

You may not use this site to break any law, misrepresent your identity or eligibility, interfere with the site's operation or security, scrape or harvest data, or purchase products for human or animal use.

12. Intellectual property

The site's content, branding, and design are owned by us and may not be copied or reused without permission.

13. Disclaimer of warranties

The site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, or goodwill, arising from your use of the site or any product. Our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim.

We are not liable for any harm resulting from human or animal consumption of our products, which is an express violation of these Terms.

15. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the site, your use or handling of any product, your breach of these Terms, or your violation of any law or the rights of a third party.

16. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. You agree to the exclusive jurisdiction of the courts of British Columbia.

17. Changes

We may update these Terms at any time. The "last updated" date above will change when we do. Continuing to use the site after an update means you accept the revised Terms.

18. Severability

If any provision of these Terms is found unenforceable, the rest remain in effect.
